TN Legal and Filing Fees
When you sponsor an employee for TN status, there is no legal requirement for the employer to cover legal or USCIS filing fees.
Legal Fees
All TN cases are handled by the SUNY-approved immigration law firm.
- $1,320 — Legal fee for TN preparation
USCIS Fees
When USCIS Fees Apply
USCIS filing fees only apply if the department chooses to file a petition with USCIS. This may occur when:
- The employee is already in the U.S. and requires a change of status to TN
- The department is requesting an extension of TN status without travel
- The department prefers a USCIS approval notice before the employee applies at the border
Standard USCIS Filing Fees
If filing with USCIS, the following fees may apply:
- $460 – Form I-129 filing fee
- $2,965 – Premium Processing (optional)
Premium Processing:
This is an optional service. USCIS will take action within 15 business days (either a decision or a request for additional information). If USCIS does not meet this timeline, the fee is refunded.
Premium Processing can be requested at the time of filing or added later if needed.
When USCIS Fees Do Not Apply
In most TN cases, USCIS is not involved:
- Canadian citizens typically apply directly at a U.S. port of entry
- Mexican citizens apply for a TN visa at a U.S. consulate
Additional Legal Costs
If USCIS issues a Request for Evidence (RFE) or additional legal work is required:
- You will be notified in advance
- Additional legal fees may apply
