TN Status for Canadian and Mexican Employees
The TN classification allows Canadian and Mexican citizens to work in the United States in certain professional roles listed under the United States-Mexico-Canada Agreement (USMCA).
Unlike other employment-based statuses, TN is tied to a specific list of professions, and eligibility is based on both the position and the individual’s qualifications. TN status is employer-specific and authorizes employment only with the sponsoring department in the approved role.
TN may be an appropriate option when the position clearly aligns with a listed profession
and the individual meets the exact credential requirements.
Key Features of TN Status
- Eligible nationals: Canada and Mexico only
- Eligible positions: Must match a USMCA-listed profession
- Initial period of stay: Up to 3 years
- Extensions: Up to 3 years per extension; no maximum limit
- Processing method:
- Canadian citizens: Apply directly at the U.S. border/port of entry
- Mexican citizens: Apply for a TN visa at a U.S. consulate
- Employer-specific: Employment is limited to the sponsoring department
TN status is considered a temporary classification, meaning the individual must intend to work in the U.S. for a limited period.
Important Reminder
TN eligibility is based on a strict regulatory framework. A position that is professional or academic in nature does not automatically qualify.
Departments are strongly encouraged to consult with VIS before making assumptions about eligibility or advising candidates.
